Introduction & Definitions. NOTE: This recruitment is open until the needs of the Department are met and may close without prior notice. Applications received by 05:30 p.m., 1/25/2019, will be reviewed to be considered for an interview at the City of Downey's Job Fair on February 9, 2019. Applications received after 05:30 p.m., 1/25/2019, will be reviewed, and interviews will be conducted as needed. • These terms, conditions, and notices (the “Terms”) govern Job Seeker, visitor, and certain Customer(s), access to and use of Governmentjobs.com, Inc. (dba “NEOGOV” and referred herein as “Company”) products, services, and websites under Company control, whether partial or otherwise, and of which are owned and operated by Company (including, without limitation, neogov.com, governmentjobs.com, websites with a governmentjobs.com resource domain, Career Pages, and the website(s) from which these Terms were accessed from) (collectively referred to as the “Services”). These terms include theGovernmentjobs.com Privacy Policy, which is incorporated into these Terms by reference. These Terms, the Governmentjobs.com Privacy Policy, and such other Company policies that may be amended from time to time, shall collectively be referred to as the “Agreement”. Any and all rights not expressly granted in this Agreement are reserved by Company. Working Hours: Governmentjobs.com Privacy Policy • Certain terms, such as Section 7 or restrictions on job postings, will only apply to you if you are a Customer of Company. A Customer is defined an organization, government, state or provincial government, city, county, government agency, municipality, federal government, K-12, special district, law enforcement, college, university, academy, or institute of technology, of which is located in the United States and utilizes Company Services to post job opportunities, search for, recruit, evaluate and select Job Seekers. A Job Seeker is a natural person who accesses, uses, or creates an account on a Company controlled Service to search for and apply to jobs advertised by Customers. Training for all selected applicants will be conducted June 3rd - 8th. Attendance is mandatory. • If you will be using the Services on behalf of a Customer, you agree to these Terms on behalf of that organization and you represent that you have the authority to do so. In such case, “you” and “your” will refer to that organization. Where these Terms conflict with either pre-existing additional terms of which were mutually and explicitly agreed to between Company and you (collectively referred to as the “Parties”), or where the Parties explicitly agreed otherwise, those additional terms shall control to the extent of the conflict. Temporary / Part-Time employment may not exceed 999 hours in a fiscal year from July 1st through June 30th. • If you do not agree to all of terms and conditions set forth in this Agreement, you may not use the Services. You indicate your agreement to this Agreement by clicking or tapping on a button indicating your acceptance of these Terms, by executing a document that references them, or by using the Services; therefore, this Agreement is a legally binding contract between you and Company (also referred to as “we”, or “us”). Also, by agreeing to this Agreement you waive, to the extent permitted under applicable law, any rights or legal requirements that require an original (non-electronic) signature or the delivery or retention of non-electronic records in order for a contract to be legally binding. EXAMPLES OF ESSENTIAL FUNCTIONS • Enforce facility regulations, policies and procedures. • Observes swimmers and pool area from assigned station. • Performs rescues in the pool area; and administers CPR and first aid as needed. • Administer first aid as needed. • Monitor activities in swimming areas to prevent accidents. • Company reserves the right to modify this Agreement at any time, at its sole discretion, by posting an updated version to this web page. If you are a Customer with a subscription, changes to this Agreement shall be effective upon renewal of your subscription. If you are a Job Seeker, changes to this Agreement are effective immediately. You will be notified if there is a material change (as determined in the sole discretion of Company) to this Agreement. • Perform routine swimming pool and aquatics equipment maintenance work on or around the swimming pool. • Maintain records and prepare accurate written reports and may assist cashier. • Performs appropriate rescues when necessary as well as First Aid when required QUALIFICATIONS Education: Intellectual Property. Experience: • All marks contained herein, including but not limited to organization logos, trademarks, and related intellectual property of which are implemented into the Services by you, are the property of their respective owners. Company does not claim ownership of any Customer marks or property. Knowledge of: • Except as otherwise expressly set forth herein, Company is the owner of all intellectual property rights (including copyrights) in the Services, including but not limited to designs, text, graphics, images, video, information, logos, button icons, software, and audio files (collectively, “Company Content”). Material published by Company may contain other proprietary notices or describe products, services, processes, or technologies owned by Company or third parties. Nothing in these Terms shall be construed as granting to you a license to Company Content under any copyright, trademark, patent, or other intellectual property right except as expressly set forth herein. Ability to: Certification: The following current certifications are required: • American Red Cross CPR/AED for the Professional Rescuer • American Red Cross Lifeguard Training/First Aid NOTE Physical Tasks and Environmental Conditions: • Please be aware that the information, software, products, and services published within these Services may include inaccuracies, typographical errors, or out-of-date information. Changes and items are made and added to the Services and the information on it from time to time. Company may make such changes or additions at any time at its sole discretion. ADDITIONAL INFORMATION Term and Termination. • These Terms will remain in full force and effect during your subscription, while you access or make use of the Services, or while you have an active account if you are a Job Seeker. • You may terminate your Services at any time by deleting your account. Upon termination, you must destroy all copies of any aspect of Services in your possession. Part 1: • Company reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to removal of some or all of your content from the Services, issuance of a warning, or immediate termination of your ability to access the Services. Company may also terminate your account and access upon any breach by you of these Terms or in order to protect its name and goodwill, its business, and/or other users. Such termination may be effective without notice. If at any time during your use of the Services, you made a misrepresentation of fact to Company or otherwise mislead Company in regard to the nature of your business activities, Company will have grounds to terminate your use of the Services. Part 2: Part 3: Part 4: • Upon expiration or any termination of this Agreement, you shall cease all use and refrain from all further use of the Services and other Company Intellectual Property. • In addition to the Miscellaneous section below, the provisions concerning Company’s proprietary rights, feedback, indemnity, disclaimers, limitation of liability, Company monitoring and pre-screening, information collection, your responsibilities, governing law, and any other section herein that by its nature is intended to survive termination, will survive the termination of this Agreement for any reason. Your Use; Limited License. • The Services are for your personal and noncommercial use. Except as otherwise expressly provided, you may not modify, copy, distribute, transmit, display, perform, reproduce, use, publish, license, create derivative works from, transfer, or sell any information or content contained in the Services as a whole software, or products or services obtained from or available as part of or in conjunction with the Services. You are granted a non-exclusive, non-assignable, and non-transferable license to use the Services only under the terms and conditions of this Agreement. Agency • This license is not a sale of any of Company’s rights. The Services may be used only by you, and you may not rent, lease, lend, sub-license, or transfer the Services or any of your rights under this Agreement to anyone else. You may not develop or derive for commercial sale any data in machine-readable or other form that incorporates or uses any substantial part of the Services. • You must be 13 years of age or older to visit or use the Services in any manner. If under the age of 18 or the age of majority as that is defined in your jurisdiction, you must use any Services under the supervision of a parent, legal guardian, or other responsible adult. Your Responsibilities. • As one of the conditions of your use of the Services, you represent, warrant, and agree that you will not use (or plan, encourage, or help others to use) the Services for any purpose or in any manner that is prohibited by this Agreement or applicable law. It is your responsibility to ensure that your access and use of the Services complies with these Terms and to seek prior written permission from Company for any uses not permitted or not expressly specified herein. • You shall be solely responsible for the accuracy and completeness of all records, data, and information provided, submitted, or uploaded by you in connection with this Agreement or use of the Services
