Duties The primary duty of this position is to conduct, either independently or as the leader of an investigative team, complex civil and criminal investigations of individuals and labor organizations that have violated or may violate the LMRDA. The emphasis will be on civil investigations. • Leads, plans and conducts investigations and enforcement activities and completes complex and difficult civil and criminal investigations, compliance audits (including international audits), and supervised elections under the LMRDA and other related laws. Assignments at this level include leading ad hoc teams or special initiatives, as well as providing guidance and expertise to other staff during broad scope investigations, and assisting the District Director in the planning and implementation of enforcement activities within the office jurisdiction. **a**. Recommends changes in existing enforcement policies, programs, goals, and objectives to the DD.** b.** As assigned, develops proposals, recommendations, and suggestions to ensure an effective enforcement program within the office jurisdiction. **c.** Assigns and reviews work for ad hoc team members, as directed by the DD. **d**. Initiates enforcement activities based on research and study of targeting data including financial reports submitted by labor organizations, news articles, tips from union members, referrals from other enforcement agencies, and the OLMS computerized databases. Prepares investigative plans, outlining issues to be probed and general approaches to be followed, and estimates resources required.** e.** Initiates and conducts meetings, discussions and conferences with parties germane to the investigation such as union officers, employees of the unions, attorneys and certified public accountants, employers and union members. **f.** Independently conducts, or, leads and directs civil and criminal investigations including the analysis of accounting and financial records, the structure, philosophies, policies, and operating practices of the labor organization. Assesses interim findings to identify and determine which activities to examine further or where efforts should be redirected. **g.** Determines when investigations should be expanded to other OLMS offices throughout the nation and proposes specific or general ancillary/auxiliary investigations. Serves as agency coordinator for joint investigations with the FBI, IRS, DOL-OIG, and other federal, state, and local law enforcement agencies. Safeguards grand jury materials. **h**. Reviews investigative findings, including those of ad hoc team members, and consolidates them. Prepares comprehensive, well documented, sign-off quality reports of investigative findings, and recommends appropriate dispositions. Prepares and correlates evidence. Negotiates with labor union officials or their representatives and/or attorneys and certified public accountants to correct violations and reach settlement. **i.** Initiates contact and works closely with the U.S. Attorney or Assistant U.S. Attorneys and legal staff of the Solicitor’s Office in preparing cases for civil litigation and criminal prosecution. Testifies before federal and state grand juries and serves as a witness in respective trial courts. As assigned, prepares criminal complaints and draft indictments for Assistant U.S. Attorneys and state prosecutors provides advice during trial concerning investigative findings and/or matters and past practices of the union and OLMS. • Directs or Supervises Rerun Elections Plans, for important union offices, which may involve intermediate or national levels in large unions, either under a court order or voluntary agreement with the union. Independently researches issues and develops an effective pre-election strategy, prepares the agenda, initiates and conducts the pre-election conference with union members, officers, attorneys, and other interested parties to set ground rules and the election schedule. • Conducts Compliance Assistance Activities Provides technical guidance and assistance to International/National labor organization and, affiliated union officials, and interested parties to achieve and improve compliance with the regulations and statutory requirements of the LMRDA and related statutes. • Initiates Contacts and Maintains Liaison Activities with United States Attorney’s offices and state prosecutors, other federal, state, and local law enforcement agencies.
